JibJab — Notice of Right to Opt Out of Sale or Sharing of Personal Information

Your privacy is important to us.
If you are a California resident, you have the right to opt out of the "sale" or "sharing" of your Personal Information under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, "CCPA/CPRA"), Civil Code §1798.100 et seq. This Notice explains that right as it applies to JibJab, which is owned and operated by JibJab, LLC, a subsidiary of Mode Mobile, Inc. ("JibJab," "we," "us," or "our"). All capitalized terms used but not defined in this Notice have the meanings given to them in the CCPA/CPRA or applicable regulations thereunder.
What "Sale" and "Sharing" Mean
"Sale" means disclosing or making available your Personal Information to a third party in exchange for monetary or other valuable consideration.
"Sharing" means disclosing or making available your Personal Information to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.
We may sell or share certain categories of Personal Information — including identifiers (such as email address, hashed email identifier, IP address, and device identifiers), commercial information (such as subscription and purchase history), internet or network activity (such as your interactions with our website, apps, eCards, and videos), approximate geolocation data, and inferences — with advertising partners, analytics providers, and identity-resolution platforms, as described in our Privacy Policy.
How to Exercise Your Opt-Out Right
You may opt out of the sale or sharing of your Personal Information at any time using any of the following methods:
Opt-Out Preference Signal: We treat a recognized opt-out preference signal, such as Global Privacy Control (GPC), sent from your browser or device as a valid request to opt out of the sale and sharing of Personal Information associated with that browser or device.

We will process your request within fifteen (15) business days of receipt and will notify you of our response. We will not require you to verify your identity to opt out, but we may ask for information reasonably necessary to locate your account or records and process your request.
Using an Authorized Agent
You may use an authorized agent to submit an opt-out request on your behalf. Requests submitted by an authorized agent must include written permission signed by you designating the agent to act on your behalf, or a valid power of attorney executed pursuant to California Probate Code §§4000–4465. We may deny a request from an agent who does not provide this documentation.
What Happens After You Opt Out
Once we process your opt-out request, we will stop selling or sharing your Personal Information with third parties for the purposes described above, subject to any exceptions under applicable law. We will also notify any third parties to whom we sold or shared your Personal Information after you submitted your request and before we processed it, directing them to comply with your request and forward it to any other person with whom they made the information available.
Your opt-out choice will remain in effect until you instruct us otherwise. You may opt back in to the sale or sharing of your Personal Information at any time by contacting us at help@jibjab.com.
Right to Limit Use of Sensitive Personal Information
In addition to the opt-out right described above, the CCPA/CPRA gives California residents the right to limit the use and disclosure of "Sensitive Personal Information" to purposes permitted under applicable regulations. As used in JibJab, Sensitive Personal Information may include facial data derived from photos you upload to create personalized eCards, videos, and other content [confirm whether JibJab extracts facial geometry or other biometric identifiers from uploaded photos]. We use this information solely to provide the personalization features you request and for security and fraud prevention, and we do not use or disclose it for purposes beyond those permitted by the CCPA/CPRA. Non-Discrimination
We will not discriminate against you for exercising your rights under the CCPA/CPRA, including by denying you goods or services, charging you different prices or rates, providing you a different level or quality of services, or suggesting that you will receive a different price or quality of services as a result of exercising your rights, except to the extent permitted by applicable law.
